• Platform: Signifies a marketplace facilitating the connection between Sellers and Buyers for the sale of Products.
• Buyer: Encompasses a natural person with full legal capacity, a legal entity, or an organizational unit with legal capacity, entering into an Agreement with the Seller.
• Consumer: Denotes a Buyer residing in the European Economic Area, acting for non-commercial purposes.
• Agreement: Represents the sales contract between the Seller and the Buyer, governed by these Terms and Conditions.
• Goods: Refers to tangible movable items.
• Seller: Identifies the entity selling its Products to Buyers on the Platform.
• Seller’s Store: Constitutes a dedicated space on the Platform displaying the Seller’s offers, along with relevant information and contact details.
• Digital Content: Encompasses data provided in digital form, such as game activation codes, top-up cards, and subscriptions.
• Order: Signifies the Buyer’s declaration on the Platform, specifying the desired Product type and quantity, aimed at concluding an Agreement with the Seller.

1. GENERAL PROVISIONS

2.1. These Terms and Conditions delineate the rules for concluding and executing Agreements on the Platform, with deference to Platform-specific terms and conditions in case of conflicts. Buyers are obligated to read and adhere to these Terms and Conditions.

2.2. Consumer rights under applicable law are not affected by these provisions.

2.3. Buyers can access these Terms and Conditions online or request a durable medium copy from the Seller.

2.4. Buyers must not post illegal content on the Platform, and usage must comply with the law, decency, and third-party rights.

2.5. Buyers affirm their legal capacity to enter into binding Agreements governed by these Terms and Conditions.

2.6. Sellers may use Buyer data for Agreement performance, with Buyers confirming the accuracy of provided information.

2.7. Buyers can communicate with Sellers through specified means, with communication costs borne by the Buyers.

2.8. Buyers are urged to implement necessary technical measures to secure their data due to Internet-associated risks.

1. ORDERS

3.1. Buyers can place Orders for Products daily on the Platform, confirming awareness of payment obligations.

3.2. Orders require Buyers with full legal capacity, aged 18 or over.

3.3. Additional services may be purchased along with Products if available on the Platform.

3.4. Product information on the Platform invites offers, and placing an Order constitutes a Buyer’s offer for Agreement.

3.5. Orders require upfront payment of the total price, including additional costs, for the specified Products.

3.6. Sellers confirm Orders via email, constituting Agreement acceptance.

3.7. Limits on the number of Products may apply, communicated during Order placement.

1. PAYMENT

4.1. Displayed prices on the Platform are gross prices, with additional charges outlined during checkout.

4.2. Payment methods are displayed during the purchase process.

4.3. Payments must be made during the purchasing process.

4.4. Seller’s invoicing policy is detailed on the Seller’s Store.

4.5. Sellers must confirm Agreements and fulfill legal obligations for Consumers, providing necessary confirmations.

4.6. Seller bears taxes unless Buyer is liable as per applicable legislation.

4.7. Payment service providers facilitate transactions, with Buyer agreeing to automatic authorization.

4.8. Information on payments may be shared with Seller for Platform operation.

4.9. Seller-Seller's service provider relations are separate from these Terms and Conditions.

4.10. Sellers may participate in promotional programs, reflected in displayed offers.

1. DELIVERY

5.1. Physical Products are delivered to specified countries, while Digital Content is delivered through an external partner.

5.2. External partners facilitate Digital Content storage and delivery.

5.3. Products are delivered within specified time frames.

5.4. Sellers must deliver defect-free Products.

1. LIABILITY

6.1. Sellers indemnify the Platform Operator against claims related to Agreement execution and violation of rights.

6.2. Sellers indemnify the Platform Operator for claims arising from Agreement execution, Platform use, breach of these Terms and Conditions, or third-party rights.

1. COMPLAINT

7.1. Buyers can submit complaints via specified communication means, with costs borne by Buyers.

7.2. Sellers respond to complaints within 14 days.

7.3. EU Consumers may use the ODR platform for dispute resolution.

7.4. In cases where there is an issue with the purchased Product, the Seller reserves the right to request additional evidence or information from the Buyer to facilitate the resolution process. If the Buyer refuses to cooperate or provide the requested evidence, the Seller retains the right to deny a refund for the Buyer's order. Cooperation from the Buyer is essential to ensure a fair and effective resolution of any product-related concerns. The Seller is committed to addressing complaints promptly and efficiently, provided the Buyer actively participates in the resolution process.

1. WITHDRAWAL FROM THE AGREEMENT BY CONSUMERS

8.1. Section 10 governs the right of withdrawal for Consumers.

8.2. Consumers can withdraw from the Agreement within 14 days.

8.3. Withdrawal periods vary based on the type of Agreement.

8.4. Consumers declare withdrawal with Seller acknowledgment.

8.5. The Seller confirms withdrawal receipt on a durable medium.

8.6. Sellers refund payments promptly.

8.7. Consumers return Products within 14 days, covering direct return costs.

8.8. The right to withdraw does not apply to specific Agreements.

1. MISCELLANEOUS

9.1. Sellers can amend these Terms and Conditions, notifying Buyers at least 15 days before changes.

9.2. These Terms and Conditions constitute a direct agreement between Sellers and Buyers without intermediaries.

9.3. Sellers explicitly state that, in the event of a customer's accidental purchase or order placement error, the supplier retains the right to decline refund requests. Once an order is confirmed and processed, buyers are responsible for ensuring the accuracy of their purchase, and the supplier is not obligated to refund orders resulting from customer mistakes. It is the buyer's responsibility to review and verify all order details before confirming the purchase. This provision is in effect unless otherwise required by applicable law.
